Service of process is the procedure employed to give legal notice to a person (such as a defendant or witness) of a court or administrative body's exercise of its jurisdiction over that person so as to enable that person / business entity to respond to the proceeding before the court, body or other tribunal. Personal service is service of process directly to the entity named on the summons, complaint or petition. In most lawsuits, personal service upon a director, owner or authorized agent is required to prove service. An affidavit of service must be filed with the court immediately after service was made. The affidavit of service must comply specifically to Florida Law or it may be deemed invalid or could be quashed by opposing counsel. However, affidavits of service are easily amended, without jeopardizing the service.
